The compliance picture varies substantially between these families, and treating them all the same is how Dodge swap projects end up with paperwork problems.

The Federal Baseline

Federal law sets the floor. The Clean Air Act makes it illegal to remove, disable, or render inoperative any emissions control device the manufacturer installed on a vehicle being driven on public roads. That covers catalytic converters, EVAP systems, EGR where equipped, oxygen sensors, and the ECU calibration. For diesel applications, it adds DPF (Diesel Particulate Filter), SCR (Selective Catalytic Reduction), and DEF (Diesel Exhaust Fluid) systems on emissions-equipped variants.

For Dodge engine swaps, the federal rule that matters most: the replacement engine must bring all emissions equipment originally on it, and that equipment must be the same as or newer than what the vehicle was originally certified with.

For Cummins diesel applications specifically, the federal enforcement around emissions equipment removal has intensified substantially over the last several years. EPA enforcement actions against tuning shops and individuals who delete DPF and DEF systems have produced multi-million-dollar settlements. CARB States: California Plus Thirteen Others

CARB emissions rules apply in California and thirteen states that have adopted them in whole or in part. If the Dodge you're swapping is registered in any of those states, CARB rules effectively are your rules.

For a same-year same-engine Dodge replacement, CARB compliance is straightforward. Install the equivalent engine with all emissions components intact, document the work, and the swap clears smog like any other repair.

For year-mismatched or platform-mismatched Dodge swaps, CARB requires an Executive Order (EO) number specific to the swap configuration. Without an EO, the swap is not legal for street use in CARB states.

Non-CARB States

For Cummins applications, documentation expands to include verification of DEF tank, SCR catalyst, DPF condition, and EGR cooler operation. Keep all of that in the customer file for the life of the vehicle.

The Catalytic Converter and Diesel Aftertreatment Bottleneck

For HEMI and Pentastar applications, catalytic converters are the most common reason a Dodge swap fails inspection. Federal law requires the converter to match or exceed original vehicle certification. CARB states require OEM or CARB-EO-approved aftermarket. Quote the converter into the job up front.

For off-road and competition use, performance HEMI swaps are legal in any state. Street use requires the EO or federal-compliance path, depending on state.

The Cummins Delete Question

Cummins diesel "delete" projects — removing DPF, SCR, EGR, and other emissions equipment — are not legal for street use in any state under federal law, regardless of state-level enforcement. The EPA has prosecuted multiple cases of street-driven deleted diesels with substantial penalties.

Off-road and competition deletes are legal where state rules allow. Streetable deletes do not exist within current federal regulations.

For shops, this matters as a business risk. Performing diesel deletes on customer vehicles intended for street use exposes the shop to federal liability that can dwarf the revenue from the work. The compliance picture has shifted substantially over the last five years, and treating Cummins deletes the way they were treated in 2018 is now a serious business risk.
